Terms of service – holiday cottage rental

§1. General provisions

These terms set out the rules for booking and renting the holiday cottages of MITKOWSCY SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, UL. POZNAŃSKA 44, 62-330 NEKLA, NIP:7891800319, REGON:525354881, tel:+48 519140517, Email: anastazewo.domki@gmail.com
Making a booking means the Tenant accepts these terms.
The Landlord reserves the right to amend the terms, provided that the changes do not affect the rights of previously concluded agreements.

§2. Booking and payments

A booking can be made by phone, e-mail or through the reservation system.
A booking is confirmed by paying a deposit of 30% of the value of the stay within 2 hours of making the booking.
The remaining amount is payable no later than on the day of arrival in cash/by bank transfer or through the online payment system.

§3. Cancellation of a booking

Cancellation up to 30 days before arrival – 100% of the deposit refunded.
Cancellation less than 30 days before arrival – the deposit is non-refundable.
Shortening the stay through the Tenant's fault does not entitle to a refund.
Cancellation of a booking must be submitted in writing – by e-mail to: anastazewo.domki@gmail.com or by phone at: +48519140517.
A cancellation is effective upon its confirmation by the Landlord (return e-mail or SMS).

§4. Rules of stay

The day starts at 4:00 p.m. and ends at 11:00 a.m. the following day.
Smoking cigarettes and using open fire is prohibited in the cottage.
Pets are allowed – if accepted, an additional fee may be charged.
The Tenant is obliged to keep the cottage tidy and to use it in accordance with its intended purpose.
The Tenant is financially liable for damage caused through their fault.
Organising loud parties in the cottages and on the property is prohibited, in particular events such as stag or hen parties or other events that may disturb the peace and rest of other guests and neighbours.

§5. Liability of the Landlord

The Landlord is not liable for items left in the cottage.
The Landlord ensures the proper functioning of the cottage's equipment and the surrounding area.

§6. Final provisions

In matters not regulated by these terms, the provisions of the Civil Code apply.
These terms enter into force on 2 October 2025.

§7. Complaints

The Tenant has the right to submit a complaint if the service is not provided in accordance with the agreement or the description presented on the website.
Complaints should be submitted without delay, but no later than within 14 days of the end of the stay, to the e-mail address: anastazewo.domki@gmail.com or in writing to: UL. POZNAŃSKA 44, 62-330 NEKLA.
The complaint should include the Tenant's details, the reservation date, a description of the objections and any evidence (e.g. photos).
The Landlord considers the complaint within 14 days of its receipt and sends a reply by e-mail or in writing.

§8. Withdrawal from a distance contract

Pursuant to Art. 38(12) of the Consumer Rights Act, the Tenant is not entitled to withdraw from a distance contract for accommodation services if the contract specifies the day or period of provision of the service.
This means that after making a booking, the Tenant cannot withdraw from the contract under the general rules provided for online sales.
The Tenant does, however, have the right to cancel the booking under the rules set out in §3 of these terms.
